Acceptance of Terms

Welcome to Maison. These Terms of Service ("Terms") govern your access to and use of the Maison application and services ("Service") operated by Constant Variable LLC ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Description of Service

Maison is a home management application designed to help homeowners organize, track, and maintain their properties. The Service provides:

  • House and property management across multiple homes
  • Device and appliance tracking with lifecycle management
  • Maintenance scheduling with reminders and service history
  • Home improvement project planning and budgeting
  • Contractor and provider management with bid comparison
  • Document and media storage for home-related files
  • Electrical panel and circuit tracking
  • Data export capabilities

We continuously improve the Service and may add, modify, or remove features over time. We'll provide notice of significant changes that affect your use of the Service.

Account Registration and Security

To use Maison, you must be at least 18 years old and capable of forming a binding contract. By registering, you represent that you meet these requirements.

You agree to provide accurate, current, and complete information during registration and to update this information as needed to keep it accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you suspect unauthorized access.

Each account is for a single individual unless you subscribe to a plan that includes multi-user access. Sharing account credentials with others is not permitted except as allowed by your subscription plan.

Subscription and Payment

Maison offers the following subscription plans:

  • Basic - 1 home, up to 10 devices, 100MB storage
  • Plus - Up to 3 homes, 100 devices, 1GB storage, maintenance reminders, iOS app access
  • Pro - Unlimited homes and devices, 10GB storage, contractor bids, multi-user access

Subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method for the applicable fees. All payments are processed securely through Stripe.

We may adjust pricing with at least 30 days' notice. Price changes will apply to your next billing cycle after the notice period. You may cancel before the new pricing takes effect.

We offer a 30-day money-back guarantee on all plans. If you're not satisfied within the first 30 days, contact us for a full refund. After this period, subscription fees are non-refundable, but you may cancel at any time to prevent future charges.

Usage Limits

Your subscription plan determines your usage limits. Current limits include:

  • Number of homes you can manage
  • Number of devices you can track
  • Storage space for documents and media
  • Access to premium features like maintenance reminders and bid comparison

If you exceed your plan limits, we'll notify you and provide options to upgrade or reduce usage. We won't delete your data without warning, but some features may be restricted until you're within your plan limits.

Acceptable Use

When using Maison, you agree not to:

  • Violate any applicable laws or regulations
  • Upload malicious software, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal purpose or to store information about illegal activities
  • Interfere with or disrupt the Service or servers
  • Scrape, crawl, or use automated systems to access the Service without permission
  • Impersonate another person or entity
  • Upload content that infringes on others' intellectual property rights
  • Use the Service to send spam or unsolicited communications
  • Resell or redistribute the Service without authorization

Violation of these terms may result in suspension or termination of your account. We reserve the right to remove content that violates these terms.

Your Content and Data

You retain full ownership of all content you upload to Maison, including property information, device details, documents, photos, and any other data you provide ("Your Content"). We claim no ownership rights over Your Content.

By using the Service, you grant us a limited license to store, process, and display Your Content solely to provide and improve the Service. This license ends when you delete Your Content or close your account.

You are responsible for Your Content and ensuring you have the right to upload it. We don't monitor Your Content and aren't responsible for any content you or other users upload.

Intellectual Property

The Service, including its design, features, code, and branding, is owned by Maison and protected by copyright, trademark, and other laws. These Terms don't grant you any rights to our intellectual property except the limited right to use the Service as intended.

You may not copy, modify, distribute, sell, or create derivative works based on the Service without our written permission.

Service Availability

We strive to keep Maison available and reliable. However, as a small-scale service, we operate on a best-efforts basis rather than guaranteeing specific uptime percentages.

Planned maintenance is typically performed during low-usage periods and we aim to provide advance notice when possible. Emergency maintenance may occur without prior notice to address critical issues.

Customer support is provided via email. We aim to respond to inquiries within a few business days, though response times may vary. We don't offer 24/7 support or guaranteed response times.

While we work hard to prevent service interruptions, we cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We don't warrant that the Service will meet your specific requirements, operate without interruption, be error-free, or that defects will be corrected. Your use of the Service is at your own risk.

Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or business opportunities, even if we were advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Maison and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

You may cancel your subscription and close your account at any time through your account settings or by contacting us. Upon cancellation, you'll retain access until the end of your current billing period.

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. We'll provide notice and an opportunity to remedy violations when practical.

Upon termination, your right to use the Service ends. You may export your data before termination. We'll retain and delete your data according to our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, the Service, or legal requirements.

For material changes, we'll notify you via email or through the Service at least 30 days before they take effect. The updated Terms will be posted with a new effective date.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you disagree with any changes, you may cancel your account before they take effect.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Washington State. You consent to the personal jurisdiction of these courts.

General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maison regarding the Service and supersede any prior agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations under these Terms without restriction.
